RESTAURANT – EVENTS
1. Purchase process & conclusion of the agreement
a. Online purchases commence as soon as the customer makes a reservation and/or places products in the online shopping basket (e.g. a gift voucher). The agreement becomes effective as soon as the customer has ticked the box confirming acceptance of these terms and conditions and subsequently confirms the order or reservation.
For reservations and orders not made via the website, Hotel Geerts will, where possible, confirm the arrangements made with the customer by e-mail, referring to the applicable terms and conditions by means of a clickable link or attachment. The agreement becomes effective as soon as Hotel Geerts has sent this confirmation to the customer.
b. Products or services purchased by the customer, whether online or otherwise, are described on the website in sufficient detail to enable the customer to assess them correctly. If the customer is uncertain about the content, characteristics or price of the offer, the customer must contact Hotel Geerts for further information before completing the ordering process.
2. Reservations, confirmations, reminders & waiting list
a. Hotel Geerts reserves the right to accept or refuse reservations (e.g. if a request originates from a profile that appears fraudulent or from a customer with whom Hotel Geerts has an ongoing dispute). A reservation only becomes final once it has been confirmed to the customer by Hotel Geerts and any required deposit has been received. Hotel Geerts may subsequently remind the customer of the reservation by e-mail and/or SMS using the e-mail address and/or telephone number provided by the customer for this purpose.
b. If no tables are available in the restaurant on the requested date and at the requested time, the customer may, if desired, register a provisional reservation via the “Waiting List” on the website. The customer must provide the requested personal details and payment card information, after which the customer will receive a confirmation e-mail. The customer can confirm the provisional reservation via this e-mail. If the requested reservation becomes available and can be confirmed, Hotel Geerts will contact the customer and any applicable deposit will become payable.
c. For groups of 10 persons or more, the customer must reconfirm the reservation at least 8 days prior to arrival and provide the menu selection for the entire party. If the customer fails to reconfirm the reservation in due time, this will be considered a “cancellation” in accordance with Article 5.
d. The customer expressly agrees that Hotel Geerts may send reminders by e-mail concerning reservations made or outstanding deposit payments.
e. For technological reasons, Hotel Geerts cannot guarantee the successful delivery of e-mail confirmations and/or reminders in all circumstances. Incorrect contact details provided by the customer may also prevent such messages from being sent or received. Failure by the customer to receive a confirmation or reminder can never constitute grounds for terminating the agreement or be considered a valid cancellation. If the customer has not received a particular confirmation or reminder, the customer may at any time request Hotel Geerts to resend it.
3. Prices
a. Prices communicated by Hotel Geerts to the customer and/or displayed on the website are always stated in euros and include VAT and statutory taxes, unless explicitly stated otherwise. Any temporary offers and promotions will be clearly and separately indicated.
b. Hotel Geerts takes the utmost care when displaying prices on its website. Unintentional pricing errors are not binding upon Hotel Geerts as long as the distance purchase has not been concluded. The prices shown in the order summary on screen or in the order confirmation sent by e-mail shall apply.
c. All offers are subject to availability. Hotel Geerts cannot be held liable for the availability or unavailability of products or ingredients, particularly as Hotel Geerts works with fresh ingredients whose availability depends on daily market supply. If products, ingredients or menu options are unavailable, Hotel Geerts will offer the customer an equivalent alternative.
d. Prices displayed are not necessarily all-inclusive. The customer may order additional drinks, consumptions or options in the Restaurant, which will be charged separately at prevailing market prices.
e. Where a menu is selected for the entire table, Hotel Geerts will make every reasonable effort to accommodate the preferences of each guest. If a menu formula including matching wines is selected and not everyone at the table drinks alcohol, we will provide an appropriate alternative. We will also accommodate allergies and pregnancy-related dietary requirements to the greatest extent possible, provided these are communicated in good time when making the reservation or to our restaurant staff. Such menu adjustments do not entitle the customer to a discount.
4. Deposit for groups of 10 persons or more
a. The customer accepts that Hotel Geerts may request a deposit and may reasonably determine or adjust its amount at its own discretion where necessary.
b. Hotel Geerts will confirm the amount and payment terms of the deposit to the customer. Hotel Geerts will also specify the payment deadline, which may vary depending on the time of the order or reservation. If the deposit has not been received within the specified period, Hotel Geerts has the right to unilaterally terminate the agreement without being liable to pay any compensation to the customer. This explicitly includes failure to successfully complete an online payment within 30 minutes following confirmation of the purchase.
c. Payment of a deposit implies the customer’s irrevocable acceptance of these terms and conditions, including the cancellation policy contained herein.
d. Except in the event of a valid exercise of the right of withdrawal or a valid cancellation, the customer shall pay the outstanding balance on the day of the restaurant visit. The deposit already paid will be deducted from the total amount due.
5. Cancellation policy & changes to reservations
a. If the customer wishes to cancel or modify a reservation, whether provisional or confirmed, this must be done via the clickable link in the confirmation e-mail received through the online reservation system, OR by e-mail, OR by telephone, after which Hotel Geerts will confirm the cancellation by e-mail. Cancellations and requests to modify reservations made through other channels, such as SMS or social media, will not be accepted.
b. Whether and to what extent the customer is entitled to reimbursement of deposits already paid depends on the time at which the cancellation confirmation was sent and the size of the intended party. Hotel Geerts applies a fixed cancellation charge per person. The balance of the deposit paid, less the applicable cancellation charge, may be refunded to the customer as follows:
For reservations of 2 to 9 persons:
- Full release of the pre-authorisation upon cancellation.
For reservations of 10 persons or more:
- Full refund if cancelled more than 7 calendar days before the scheduled restaurant visit.
- 50% refund if cancelled more than 3 calendar days before the scheduled restaurant visit.
- The full deposit amount will be retained as a cancellation charge if the reservation is cancelled within 3 calendar days of the scheduled restaurant visit.
In the event of a “no-show”, the customer will be liable for a cancellation charge of €50 per person. If this amount exceeds the deposit already paid, Hotel Geerts will confirm the outstanding balance and payment terms to the customer by e-mail.
c. Cancellations and modifications are processed only during office hours (Monday to Friday: 09:00–17:00) and not during holiday periods. Customers are requested to take this into account and to communicate any cancellation or request for modification in good time.
d. Refunds of deposits by Hotel Geerts following cancellation will, as standard, be made in the form of a “Gift Voucher”, which the customer may use towards a future reservation, unless the parties expressly agree otherwise.
e. No interest shall be payable on deposits or refunds of deposits.
f. Providing or submitting payment details when making an online or other reservation automatically implies that the customer agrees to Hotel Geerts’ cancellation policy and irrevocably authorises Hotel Geerts to charge any amounts due to the credit card or debit card provided, or by means of invoicing.
6. Cooling-off period & right of withdrawal
a. A customer acting as a natural person and purchasing for non-professional purposes has the right to withdraw from the purchase without penalty and without giving any reason within 14 calendar days from the day following delivery of the goods or conclusion of the service agreement. Where the agreement concerns the delivery of goods, the customer must return the goods received to Hotel Geerts, with the direct costs and risks associated with the return remaining at the customer’s expense.
b. The right of withdrawal does not apply to:
- Services whose performance has begun, with the customer’s consent, before the end of the cooling-off period.
- Goods manufactured according to the consumer’s specifications or which are clearly personalised.
- Goods which, by their nature, cannot be returned.
- Goods which are liable to deteriorate or expire rapidly.
In practical terms, this means that the customer does not have the right to withdraw from the agreement with Hotel Geerts in the following cases:
- The customer makes the reservation or places the order in the capacity of a trader or for professional purposes.
- The customer purchases a gift voucher which has already been used at the time the customer seeks to exercise the right of withdrawal.
- The goods supplied contain food products.
- The customer reserves services scheduled to be performed within the 14-calendar-day period.
c. If the customer wishes to exercise the right of withdrawal, the customer must notify Hotel Geerts thereof in writing and within the applicable period.
